Terms of Service Agreement

Welcome to The AquaBench. These Terms of Service (“Terms”) govern your use of our website (theaquabench.com) and the purchase of our submersible underwater products (The AquaBench).
By accessing our site or purchasing The AquaBench products, you agree to be bound by these Terms. Please read them carefully before making a purchase.


1. Product Specifications and Use
Our submersible underwater benches are specialized products designed for use in controlled aquatic environments (e.g., swimming pools, engineered water features).
  • Intended Use: The AquaBench is strictly for seating while submerged in water. 

2. Installation and Safety
  • Weight Limits: The Aqua Bench specifies a maximum weight capacity of 400 lbs for the bench in the water. Exceeding this limit is done at the user's own risk.

3. Orders, Pricing, and Payment

 

  • Payment: Payments are processed securely via Shopify Payments. You agree to provide current, complete, and accurate purchase and account information.

4. Shipping and Delivery
  • Freight and Custom Delivery: Due to their size and weight, these Products often ship via specialized freight carriers.
  • Access Requirements: You must ensure your delivery location is accessible to freight trucks. You are responsible for any additional fees incurred if delivery is impossible due to location constraints.
  • Inspection: You must inspect the Product upon delivery. Note any damage on the delivery receipt and notify us within 48 hours of delivery.

5. Returns and Cancellations

 

  • Standard Products: For non-custom items, you may initiate a return within 72 hours. The Product must be in its original, unused condition and packaging. You are responsible for all return shipping costs, including freight fees.

6. Warranties and Limitation of Liability
  • Limited Warranty: The Product comes with a 1 year limited warranty against manufacturing defects. This warranty does not cover damage caused by misuse.
  • Limitation of Liability: To the maximum extent permitted by applicable law, The Aqua Bench shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use, misuse, or inability to use the Product, including but not limited to, property damage, drowning, or personal injury.

7. Indemnification
You agree to indemnify, defend, and hold harmless The AquaBench and our affiliates, partners, and employees from any claim or demand (including reasonable attorneys' fees) made by any third-party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third-party.

8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of U S.without regard to its conflict of law provisions.
